    Colorado State Parks

    Hi Everyone,

    I wondered if anyone here is aware of any updates on whether or not hammocks are allowed in Colorado State Parks. I am already aware of the older thread here:

    We are getting a new state park in Colorado soon and it's close enough to me that I'd really want to be able to hang a hammock there when it opens. I'd actually go as far as petitioning for an amendment to the rules to see if I can get anywhere with that.

    As far as I have heard - for example Lori State Park just west of us - No restrictions as far as I have heard - Friends there this summer and our friend is a Ranger who knows my passion for hanging - No word about any restrictions

    Last time I called to talk to the folks at Staunton State Park, they confirmed that you can't tie anything to trees, so unfortunately, that's a no. Hopefully it changes at some point, but this info is only around 6 months old.

    From the Colorado Parks and Wildlife page Staunton State Park Bans hammocks outright ( in-between Conifer and Bailey) but as near as I can tell just this one.

    And finally in this article I found the information I was looking for - If you want to go hammock camping in Colorado at one of their state parks you probably need to look up the specific regulations for that park. Read through the whole article but you'll see they basically suggest that each park has its own set of regulations regarding hammock usage.

    Specifically on the state level there is no outright ban. And on a federal level you can disperse camp - I have had multiple conversations with the rangers at the Canyon Lakes District office here in Fort Collins off of Research BVLD next to the USDA building regarding this.
    So there is no ban regarding that as long as you're on national forest land and abide by all dispersed camping regulations (The rangers tell me if there's a specific area that you're looking at you should be able to pull a map up and if there are restrictions they will be listed in the map perhaps not hammock camping restrictions but restrictions regulating or limiting dispersed camping).
    There may be some specific areas that regulate this differently throughout Colorado but specifically regarding the Canyon Lakes District there are no restrictions. See regulations below.

    Here is an article that sums up the real situation for Colorado State Parks in terms of an actual Ban - Spoiler Alert - NO BAN EXISTS. It appears to be a case by case basis and this article sums that up the best that I have found;

    I also will attach the actual regulations for colorado state parks so all can see there really isn't a ban. The article states this but Hammocks aren't even mentioned in the regulations.

    Okay so the people at the Colorado Parks and Wildlife answered my email as to this question so see below but it IS BAD NEWS;

    Hi Sean,
    Thank you for contacting Colorado Parks and Wildlife!
    All of our state parks prohibit using hammocks that strap to trees. This is listed under a regulation that states that it is prohibited to mutilate, modify or deface any structure, including trees. Straps, ropes, and chains can damage the bark on a tree. For the specific regulation, click on the link below. It is under Article 1, #100 - Parks and Outdoor Recreation Lands, section C, under #2. Hammocks that are held up by stands are allowed. Jackson Lake state park will have hammock stands at all campsites in summer 2020.

    C. It shall be prohibited:

    2. To remove, destroy, mutilate, modify or deface any structure, water
    control device, poster, notice, sign or marker, tree, shrub or other
    plant or vegetation, including dead timber and forest litter, or any
    object of archaeological, geological, historical, zoological or natural/
    environmental value or interest on Parks and Outdoor Recreation Lands.
    (This regulation does not include removal of firewood from designated
    firewood areas, noxious weeds as defined by statute, or recreational
    gold mining within the Arkansas Headwaters Recreation Area, except
    where prohibited as indicated by posted signs.

    The Statute that covers this is likely:
    33-6-129. Damage to property or habitat under division control
    (1) It is unlawful for any person to remove, damage, deface, or destroy any real or personal property or wildlife habitat under the control of the division. Any person who violates this subsection (1) is guilty of a misdemeanor and, upon conviction thereof, shall be punished by a fine of not less than one hundred dollars nor more than one thousand dollars, or by imprisonment in the county jail for not more than one year, or by both such fine and imprisonment. In addition, the court may require the defendant to reimburse the division for any damages.
    (2) It is unlawful for a person to use division property in violation of any commission rule. Any person who violates this subsection (2) is guilty of a misdemeanor and, upon conviction thereof, shall be punished by a fine of one hundred dollars.

    This does not deny the use of hammocks. It probably would result in a citation under 33-6-129, but it would need to be proven that the attachment of the hammock strap actually damaged or defaced the tree. And those words will also have a level of impact to meet the legal definition of what constitutes mutilation of defacement.

    So if you got a spare $20K or more to fight the citation through the Co. courts go for it. I don't.

    See my post above yours, but the Colorado Parks and Wildlife finally responded to one of my emails. She spells out exactly why hammocks are prohibited in ALL state parks except the one she mentions that has hammock stands coming in 2020.
