As i have created it, and its quite different pattern.
But they may have a different opinion so will see what they say.

After discussing with the kryptek legal team
They have a clause in their patent that uses the term
substantial similarity
And my pattern fails this test and yes i agree with that. With a term in the patent that is subjective basically with enough money you could argure anything that is remotely close to their design is a no go.
So this will not be used.
I may make another one or not i dont know.
But it is a great lesson in custom ink on fabric, if you have been inspired by another design then it might mean that you cant use it.

That's a bummer, I really liked the progression of the images. It seems as though you were on to something.
It's also something I never really thought too much about... that is the actual design process of camouflage. It never really occurred to me that there had to be a person or group of people behind the design and their intentions. I think I'm about to fall down that wikipedia rabbit-hole.
