Hmm sent an email to kryptek,
It doesnt infringe on their patents which specify a particular pattern.
As i have created it, and its quite different pattern.
But they may have a different opinion so will see what they say.

By appearance it seems like it was only small changes, but it has made a big difference. Really looking sharp now.

Well this is a no go

After discussing with the kryptek legal team
They have a clause in their patent that uses the term

    substantial similarity

And my pattern fails this test and yes i agree with that. With a term in the patent that is subjective basically with enough money you could argure anything that is remotely close to their design is a no go.

So this will not be used.
I may make another one or not i dont know.

But it is a great lesson in custom ink on fabric, if you have been inspired by another design then it might mean that you cant use it.

Sad to hear it but I'm not too surprised by their response.

Look forward to seeing your continued designs.

Yeah, he probably just gave kryptek an idea to make hammocks and tarps.

That's a bummer, I really liked the progression of the images. It seems as though you were on to something.

It's also something I never really thought too much about... that is the actual design process of camouflage. It never really occurred to me that there had to be a person or group of people behind the design and their intentions. I think I'm about to fall down that wikipedia rabbit-hole.
